Terms of use

These terms apply whenever you use PriceNow. They're written to be readable rather than impressive — the short version is: we work hard to be accurate, but the retailer's own site is always the final word on price and availability.

1. About the service

PriceNow is an information service. We collect prices published by New Zealand retailers and present them for comparison. We don't sell products, hold stock, take payment, or act as an agent for any retailer. Every purchase is a contract between you and the retailer you choose.

2. Prices and product information

• Prices are captured from retailers at a point in time and can change without notice. The capture date is shown on product pages.
• Prices are in New Zealand dollars and include GST unless stated otherwise.
• Delivery costs, stock status, specifications and images come from the retailer or manufacturer and may contain errors.
• Always confirm the final price, delivery cost and availability on the retailer's site before you buy.

We make no promise that any product is available, that a listed price is current, or that we list every retailer or every offer. See how we compare prices for our method.

3. Using the site

You may use PriceNow for your own shopping research. You agree not to:

• scrape, harvest or systematically copy the site or its data for a competing service;
• interfere with the site's operation or security, or place unreasonable load on it;
• use the site for anything unlawful, or misrepresent your affiliation with us.

4. Intellectual property

The PriceNow name, logo, site design, written content and compiled data are owned by us or our licensors. Product names, brands, trade marks and images belong to their respective owners and are used to identify products for comparison. You may link to our pages freely; reproducing substantial parts of the site requires our permission.

5. Links to retailers

Links take you to third-party websites we don't control. Their terms and privacy policies apply once you arrive. Some links are commercial: we may earn a commission if you click through or buy. This never changes the ranking — which is by price — or the price you pay. See about us.

6. Availability

We aim to keep PriceNow available and accurate, but it's provided “as is”. We may change, suspend or discontinue any part of it at any time, including features, data coverage and these terms.

7. Liability

To the extent permitted by law, we are not liable for any loss arising from your use of the site or from relying on information on it — including where a price shown here differs from a retailer's price. Where liability can't be excluded, it is limited to resupplying the service.

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply to you. Your consumer rights in respect of a purchase are against the retailer that sold it.

8. Privacy

Our privacy policy explains how we handle personal information, and forms part of these terms.

9. Governing law

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute.
